  Watch Out for Unintended Consequences

Sometimes actions can have the opposite effect of what they were supposed to have. For instance, we have a client who owns a 2-acre parcel. Ideally, he wanted to keep the parcel as one lot with minimal improvements. However, the Town decided to upzone his property from half acre zoning to two acre zoning, which would heavily impact his ability to sub-divide in the future. In order for him to maintain his half acre zoning, he had to submit a sub-division plan to the Planning Board, which, once endorsed, would freeze the half acre zoning for 8 years. At the end of the 8 years, if he and/or an entity he controlled still owned the contiguous lots, they would merge. To prevent this, he would have to sell every other lot before the 8 years are up so he no longer owned contiguous lots and therefore, there is no way for them to merge. So, that is what we are doing. If the upzone did not happen, our client would have left the property as one, 2-acre lot. Instead, he sub-divided it into four, .5-acre lots to protect his property value. A zoning change that was supposed to decrease density, actually increased density.

Remember what happened when the Town announced there was going to be a building cap to curb development? Everyone, even those who had no intention of building in the near future, got a building permit before the deadline.

What would you do if Something Natural said they would stop selling Portuguese bread tomorrow because supplies were getting low? Right, you would buy two loaves today!

Time to make it happen as we are in full swing. A client owns a well over-sized lot with fantastic views of the harbor. There are two abutting vacant lots one behind his view and one in front of his view. The one behind is just shy of having two lots. The client with the well over-sized fantastic views does not want the abutting lot in front of his views to build. Lets make it happen JPFCO style.

We propose to sell the abutting owner behind enough land as so that he will now have two conforming lots. We then take the proceeds to buy the lot in front. 'Just a crazy Hodaddy standing down by the pier. He must have grabbed my board, because mine isn't here. I know how to fix him, I'll raid that meatball flag.' No worries mate, when you catch your wave with J P F Co. you don't have to worry about Groomies, Hot Doggers and Hodaddies. You're in the hands of the Kelly Slaters', Laird Hamiltons', and MRs' of the real estate world. Not to forget the immortal J.J. Moon, but, then again who can forget J.J. Moon? They pretty much had it right: "Catch a wave and you're sitting on top of the world." 'Top of the World' = Nantucket. Instead of a gnarly experience, make sure you have a gnarlacious one. So grab your wahine, strap on you huarache sandals, shake the sand out of your bushy, bushy blond hair-do and catch your wave, Maybe hook a ride in your woody. A wave that may never crest, at least. not in the near future. We'll keep an eye out for meatball flags and you keep an eye out for Noah and men in gray flannel suits.
